By accessing or using Trivia Roast ("the Service," "the App") at triviaroast.com or any associated domain, you agree to be bound by these Terms of Use. If you do not agree, do not use the Service. These Terms constitute a legally binding agreement between you and the operator of Trivia Roast ("we," "us," "our"), currently operated as a sole proprietorship pending formal business entity registration.

2. Description of Service

Trivia Roast is an AI-powered trivia game application that generates trivia questions and humorous commentary ("roasts") in response to incorrect answers. The Service is provided for entertainment purposes only. All AI-generated content is fictional and intended for comedic effect.

3. Age Requirement

You must be at least 13 years of age to use this Service. Users selecting "Savage Mode" acknowledge that this mode contains adult language, profanity, and explicit humor, and represent that they are at least 18 years of age. By enabling Savage Mode, you confirm you are an adult and consent to adult-oriented content.

4. AI-Generated Content Disclaimer

All trivia questions, answers, fun facts, and roast commentary are generated by artificial intelligence. We make no representations or warranties regarding the accuracy, completeness, or fitness for any purpose of AI-generated content. Trivia answers and fun facts may be incorrect, outdated, or incomplete. Do not rely on any content generated by this Service for educational, medical, legal, financial, or any other purpose requiring accuracy. The roast commentary is entirely fictional and generated algorithmically — it does not reflect the views or opinions of the Service operator and is not directed at any real person's actual characteristics.

5. Content Warning — Savage Mode

Savage Mode generates content that includes strong profanity, crude humor, and adult themes. This content is intended for mature audiences who have explicitly opted in. We employ automated content moderation, but AI systems are imperfect. If you find any generated content to be genuinely harmful, threatening, or violating these terms, please contact us. We reserve the right to modify or remove any content at our sole discretion.

6. Prohibited Uses

You agree not to: (a) use the Service for any unlawful purpose; (b) attempt to circumvent any rate limiting, authentication, or security measures; (c) scrape, harvest, or extract data from the Service in bulk; (d) use the Service to harass, bully, or harm any individual; (e) attempt to inject malicious prompts or manipulate AI outputs; (f) reproduce or redistribute Service content for commercial purposes without prior written consent.

7. Purchases and Refunds

The Service offers a one-time "Pro" upgrade processed through Stripe. All purchases are final. We do not offer refunds except where required by applicable law. By completing a purchase, you authorize the charge to your payment method. Pro status is tied to your device identifier and is non-transferable.

8. Intellectual Property

The Trivia Roast name, logo, branding, application design, and underlying software are the property of the Service operator. "Trivia Roast" and the associated flame logo are claimed as common law trademarks through use in commerce. Unauthorized use of these marks is prohibited.

AI-generated question and roast content is generated uniquely per session and is not subject to copyright protection. You may share individual roast outputs for personal, non-commercial use with attribution to Trivia Roast.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS. YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE SERVICE OPERATOR BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM: (A) YOUR ACCESS TO OR USE OF (OR INABILITY TO ACCESS OR USE) THE SERVICE; (B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY; (C) ANY CONTENT OBTAINED FROM THE SERVICE; OR (D) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR DATA. IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR FIFTY DOLLARS ($50), WHICHEVER IS GREATER.

11. Indemnification

You agree to indemnify, defend, and hold harmless the Service operator and its successors and assigns from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your access to or use of the Service, your violation of these Terms, or your violation of any rights of another.

12. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of Maine, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the Service shall be resolved exclusively in the state or federal courts located in York County, Maine. You waive any objection to jurisdiction or venue in such courts.

13. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective upon posting to the Service. Your continued use of the Service after changes constitutes acceptance of the revised Terms. We will update the "Last updated" date at the top of this page.
